Deputy Attorney General, James Cole issues a memorandum “Guidance Regarding Marijuana Enforcement” to all U.S. Attorneys. It shifts course from the previous guidance issued in 2011 and green lights the mass commercialization of marijuana. “Prosecutors should not consider the size or commercial nature of a marijuana operation alone as a proxy for assessing whether marijuana trafficking implicates” federal enforcement priorities, including:
- Preventing the distribution of marijuana to minors;
- Preventing the diversion of marijuana out of state;
- Preventing violence and the use of firearms in the cultivation and distribution of marijuana; and
- Preventing drugged driving and the exacerbation of other adverse public health consequences.
